These Terms of Service (“Terms”, “Terms of Service”) govern your use of our web pages located at https://writefastly.com operated by Writefastly.

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound of them.

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at support@writefastly.com so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service.

Sometimes "words" are mentioned on this page instead of "tokens" because some people may not understand what tokens are and how they are calculated.

What are tokens?

Tokens are units of text that can be as short as one character or as long as one word. For example, the sentence "WriteFastly is great" consists of four tokens: "Write", "Fastly", "is", and "great".

Difference Between Tokens and Words

Words:

_ Words are the units of language we use in everyday communication.
_ A word is typically defined as any sequence of characters that appear together and have a specific meaning in a given language.
_ For example, in the sentence "WriteFastly is great," the words are "WriteFastly," "is," and "great."

Tokens:

_ Tokens are units of text used in natural language processing (NLP) and computational linguistics.
_ A token can be as short as a single character or as long as a word. Tokens can include punctuation marks, numbers, and special characters.
_ Tokens are used to break down text into manageable pieces for analysis and processing by NLP models.
_ For example, the sentence "WriteFastly is great" consists of 4 tokens: "Write", "Fastly", "is", and "great."

In summary, words are the meaningful units of language, while tokens are the units of text used in computational processes, which may include parts of words and punctuation. This distinction is important in NLP and AI contexts where precise text analysis is required.

Communications

By creating an Account on our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at.

Purchases

If you wish to purchase any product or service made available through Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that:

• (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase;
• and that (ii) the information you supply to us is true, correct and complete.

We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to modify the number of words charged for the output or input or impose any usage restrictions per hour, regardless of what was previously committed at the time of subscription.

These changes will be made according to our model capacity to safeguard the interests of all users and to ensure uniform access to the service. We take this step to provide equal opportunity to every user and protect the quality of our service.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

When you ask a question using any tool on the site, the number of tokens in the response is counted and deducted from your token balance.

When you make a purchase, you buy a specific number of tokens. In some languages, such as Arabic, each word may be represented by a higher number of tokens.

Basic Features

Basic features refer to all Writefastly features which are credit :

Promotions

Any promotions made available through Service may be governed by rules that are separate from these Terms of Service. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply.

Subscriptions

Some parts of Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exacta same conditions unless you cancel it or Writefastly. cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting Writefastly. customer support team.

A valid payment method, including credit card or PayPal, is required to process the payment for your subscription. You shall provide Writefastly. with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Writefastly. to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, Writefastly. will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

Usage Limit for Unlimited Package

The "unlimited" package comes with certain limitations, which vary depending on your subscription plan:

- For the PRO plan, you cannot exceed  200,000 tokens ( = 200,000 words english) per month.
- For the Business plan, you cannot exceed 600,000 tokens ( = 600,000 words english) per month.

These word limits apply to the usage within the specified billing period.

Freemium

Writefastly. may, at its sole discretion, offer a Subscription with a freemium PLAN for a limited period of time .

No credit card required to sign up for Free .

At any time and without notice, Writefastly. reserves the right to (i) modiffy Terms of Service of Free plan offer, or (ii) cancel such Free offer.

Fee Changes

Writefastly., in its sole discretion and at any time, may modify Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

At any time and without notice, Writefastly. reserves the right to (i) modify Terms of Service of Free plan , or (ii) cancel such Free plan .

Your continued use of Service after Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Refunds

We issue refunds for Contracts within seven (14) days of the original
purchase of the Contract with the condition that your words usage

• is less than 2500 Premium quality or equivalent tokens (words english) for any of our paid plans.
• and the number of fast articles should be less than 10 
• If a customer exceeds 2,500 words, for example, producing 5,000 words, within 14 days of the purchase, we offer a refund. However, the refund amount will be the original purchase price minus the costs associated with producing the service, which may include expenses for articles, photos, and related services.

Subscription Cancellation and Refund Policy

Full Refund for Non-Usage: If you have not used the tool at all (0 words usage) and request a refund within 14 days of payment, you are entitled to a full refund of the amount paid.

Cancellation Restrictions: Subscribers are not eligible to cancel annual, quarterly, or any other subscription that is not monthly once the minimum usage threshold has been surpassed.

Exception for Monthly Subscriptions: You may cancel a monthly subscription under specific conditions. Cancellation is permissible if requested within 14 days of initiating the subscription, and only if your word usage has not exceeded 2500 words and 10 fast articles.

Refund Calculation: Upon valid cancellation, a refund will be processed. The refund amount will be determined based on your usage till the date of cancellation. A proportional cost will be deducted for the words used.

1. Billing Cycle. The subscription fee for the Write Fastly ai service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method on the specific payment date indicated on the "Account" page. 

The length of your billing cycle will depend on the type of subscription plan that you choose when you signed-up for the service. In some cases your payment date may change, for example if your Payment Method has not successfully settled, when you change your subscription plan or if your paid subscription began on a day not contained in a given month. 

Visit the writefastly.com website and login go to dashboard and click on the "payment" link on the "Account" page to see your next payment date. We may authorize your Payment Method in anticipation of subscription or service-related charges through various methods, including authorizing it for up to approximately one month of service as soon as you register. If you signed up for Write Fastly ai  using your account with a third party as a Payment Method, you can find the billing information about your Write Fastly ai  subscription by visiting your account with the applicable third party.

2. Payment Methods. To use the Write Fastly service you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts.

If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. 

For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.

3. Updating your Payment Methods. You can update your Payment Methods by going to the "Account" page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).

4. Cancellation. You can cancel your Write Fastly membership at any time, and you will continue to have access to the Write Fastly ai service through the end of your billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial membership periods or unused Write Fastly ai  content.

To cancel, go to the "Dashboard payment" page and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period. To see when your account will close, click "Billing details" on the "Account" page. 

If you signed up for Write Fastly ai  using your account with a third party as a Payment Method and wish to cancel your Write Fastly ai  membership, you may need to do so through such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the Write Fastly ai  service through that third party.

5. Changes to the Price and Subscription Plans. We may change our subscription plans and the price of our service from time to time. We will notify you at least one month before any price changes or changes to your subscription plan will become effective. If you do not wish to accept the price change or change to your subscription plan, you can cancel your membership before the change takes effect.

Your account membership will continue until terminated.Unless you cancel your membership before your billing date, you authorize us to charge the subscription fee for the next billing cycle to your Payment Method (see "Cancellation" below).

It's important to note that once the payment is processed, we do not track or monitor individual preferences regarding the continuation of the service. To cancel your subscription and avoid future charges, please visit the unsubscribe page at https://writefastly.com/dashboard/user/payment

Please be aware that it is your responsibility to manage your subscription status, and failure to unsubscribe will result in continued charges without refunds. We recommend setting reminders or alerts to ensure timely action regarding your subscription preferences. We value your privacy and strive to maintain transparency in our payment processes.

Fair Usage Policy (FUP)

Writefastly is committed to providing high-quality, reliable service for all users. We expect all our users to avoid misuse or overuse of our services. Overuse by one user may impact the quality of service for others. Users are encouraged to select plans that align with their professional needs and business size. High-usage users should consider upgrading to a more robust plan, requesting a custom plan, or utilizing our business API.

The vast majority of users (over 95%) consistently operate within the defined parameters. Exceeding these parameters could lead to restricted or reduced service access, with or without prior warning.

Our system diligently monitors for automated or robotic behavior to maintain service safety and quality. Please be aware that sharing login details of unlimited accounts for monetary gains is considered illegal. Each seat is intended for one individual user only, and multiple users sharing one account are not permitted.

Warning: Please note that unusually high usage or sharing of login details could lead to account suspension or deletion without prior notice, with no possibility for refunds.

Prohibited Uses

Prohibited Uses

You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:

In any way that violates any applicable national or international law or regulation.

• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
• - To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter,” “spam,” or any other similar solicitation.
• - To impersonate or attempt to impersonate Company, a Company employee, another user, or any other person or entity.
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
• - To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of Service, or which, as determined by us, may harm or offend Company or users of Service or expose them to liability.
• - Our AI service provider “Open AI” does not permit the generation of sexual, religious and political content and hence you are strictly prohibited from generating any such content. If even by mistake, you try to generate such content, our system will give you an error message of “Unsafe Content” the first time and this is to be considered the final warning. If you try to generate such content again, your subscription will be cancelled and you will be debarred from using our services again and no refunds will be issued.
• - Users are prohibited from using Writefastly tools to search for or generate content related to unethical topics, including but not limited to hacking, medicine, politics, violence, or drugs. 
  Any such usage that violates ethical or legal standards is strictly forbidden. Failure to adhere to this policy may result in the suspension or termination of your Writefastly account. The account will be closed if violations persist.

Additionally, you agree not to:

• Use Service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party’s use of Service, including their ability to engage in real time activities through Service.
• - Use any robot, spider, or other automatic device, process, or means to access Service for any purpose, including monitoring or copying any of the material on Service.
• - Use any manual process to monitor or copy any of the material on Service or for any other unauthorized purpose without our prior written consent
• - Use any device, software, or routine that interferes with the proper working of Service.
• - Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
• - Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Service, the server on which Service is stored, or any server, computer, or database connected to Service.
• - Attack Service via a denial-of-service attack or a distributed denial-of-service attack.
•  Take any action that may damage or falsify Company rating.
  Otherwise attempt to interfere with the proper working of Service.

Writefastly Guidelines

Illegal activity: writefastly prohibits the use of our models, tools, and services for illegal activity.

Child Sexual Abuse Material or any content that exploits or harms children: We report CSAM to the National Center for Missing and Exploited Children.

Generation of hateful, harassing, or violent content:

• Content that expresses, incites, or promotes hate based on identity
• Content that intends to harass, threaten, or bully an individual
• Content that promotes or glorifies violence or celebrates the suffering or humiliation of others

Generation of malware: Content that attempts to generate code that is designed to disrupt, damage, or gain unauthorized access to a computer system.

Activity that has a high risk of physical harm, including:

• Weapons development
• Military and warfare
• Management or operation of critical infrastructure in energy, transportation, and water
• Content that promotes, encourages, or depicts acts of self-harm, such as suicide, cutting, and eating disorders

Activity that has a high risk of economic harm, including:

• Multi-level marketing
• Gambling
• Payday lending
• Automated determinations of eligibility for credit, employment, educational institutions, or public assistance services

Fraudulent or deceptive activity, including:

• Scams
• Coordinated inauthentic behavior
• Plagiarism
• Academic dishonesty
• Astroturfing, such as fake grassroots support or fake review generation
• Disinformation
• Spam
• Pseudo-pharmaceuticals

Adult content, adult industries, and dating apps, including:

• Content meant to arouse sexual excitement, such as the description of sexual activity, or that promotes sexual services (excluding sex education and wellness)
• Erotic chat
• Pornography

Political campaigning or lobbying, by:

• Generating high volumes of campaign materials
• Generating campaign materials personalized to or targeted at specific demographics
• Building conversational or interactive systems such as chatbots that provide information about campaigns or engage in political advocacy or lobbying
• Building products for political campaigning or lobbying purposes

Activity that violates people’s privacy, including:

• Tracking or monitoring an individual without their consent
• Facial recognition of private individuals
• Classifying individuals based on protected characteristics
• Using biometrics for identification or assessment
• Unlawful collection or disclosure of personally identifiable information or educational, financial, or other protected records

Engaging in the unauthorized practice of law, or offering tailored legal advice without a qualified person reviewing the information

Our platforms should not be used to triage or manage life-threatening issues that need immediate attention.

We may use third-party Service Providers to monitor and analyze the use of our Service.

No Use By Minors

Service is intended only for access and use by individuals at least eighteen (18) years old. When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

Account Sharing

Each Writefastly account is intended for individual use only. You are not permitted to share your account with anyone else. Sharing accounts is a violation of our terms and conditions.

Simultaneous Access Block

To maintain the integrity of our services, a block will be created if access is detected from two different devices simultaneously using the same account. This is to prevent unauthorized sharing of accounts and ensure fair usage.

Intellectual Property

Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Writefastly. and its licensors. Service is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Writefastly..

Copyright Policy

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to support@writefastly.com, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “DMCA Notice and Procedure for Copyright Infringement Claims”

You may be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.

These services are provided by company on an “as is” and “as available” basis. Termination

We may terminate or suspend your account and bar access to Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms.

If you wish to terminate your account, you may simply discontinue using Service.

Referral Program Terms (Affiliate Program Guidelines)

1_ Referral Rewards: When you share your referral link, you can earn up to 20,000 free words (tokens) for each account referred, and the new user will also receive free words. We reserve the right to modify the number of words awarded at any time.

2_ Referral Code Entry: Enter the referral code below if you wish to benefit from your friend's referral.

3_ Single Account Policy: Registering multiple accounts for the same person or tampering with accounts is strictly prohibited. Adherence to these terms of use is mandatory, or your account may be closed.

4_ Account Activation: The referred friend must activate their account via email (only Gmail or Hotmail) and importantly use our tool to receive the free words.

5_ Self-Referral Prohibition: You are not permitted to register using your own referral link.

6_ Paid Advertisement Restrictions: Using paid advertisements that could confuse customers is strictly forbidden.

7_ Coupon Website Ban: Affiliates cannot partner with coupon, cashback, or bargain websites. Promotions offering fictitious or exaggerated discounts are prohibited.

8_ Brand Keyword and Domain Restrictions: Using "WriteFastly" or any misspelled variations in domain names or keywords for PPC campaigns is not allowed.

9_ Deceptive Behavior Prohibition: Engaging in deceptive practices, such as sharing fake discounts or attempting to manipulate the system, will lead to account termination.

10_ Customer Deception Ban: Any form of misleading representation or false claims intended to deceive customers is strictly forbidden.

11_ Prior Approval Requirement: Written approval from our Affiliate Program Manager is required to create websites solely for promoting WriteFastly.

12_ Termination for Violations: We reserve the right to terminate your affiliate account and withhold any owed or paid commissions or any free word earnings if any terms in this agreement are violated.

13_ Inactivity Termination: Accounts inactive for 6 months may be terminated. Any unpaid commissions below the minimum payout threshold will be voided.

14_ Modification of Terms: We reserve the right to modify the Affiliate Program Terms and Conditions as necessary.
